Terms of service

1.General provisions

1. 1.

   These terms set out the rules for using the website eventonight.com, the types and scope of the services we provide on it by electronic means, how contracts for these services are concluded and terminated, and how complaints are handled. They are the terms required by Article 8 of the Polish Act of 18 July 2002 on providing services by electronic means.

2. 2.

   They also contain the terms that Regulation (EU) 2019/1150 (the “P2B Regulation”) requires online intermediation services to give business users, and that Regulation (EU) 2022/2065 on digital services (the “DSA”) requires of intermediary services and online platforms.

3. 3.

   The Service is a search and comparison site for live events such as concerts, festivals, club nights, stand-up and theatre in Europe and in North and South America. The Provider does not sell tickets (section 8).

4. 4.

   All services described in these terms are free. You do not have to buy anything from the Provider to use the Service.

5. 5.

   These terms are available free of charge on this page before a contract is concluded and at any time afterwards, in a form you can download, save and print, for example with your browser’s “Save” or “Print” function.

6. 6.

   These terms are available in every language version of the Service, and all versions have the same content. If the versions differ, the Polish version prevails, unless the version in the language in which a consumer used the Service is more favourable to the consumer.

7. 7.

   How we process personal data is explained in the privacy policy, and cookies and browser storage in the cookie policy.

2.Definitions

Capitalised terms in these terms mean:

Service

the website eventonight.com in all its language versions, including the partner panel and the APIs for partners.

Provider

the company that runs the Service, named in section 3 (“we”, “us”).

User

anyone who uses the Service, with or without an account (“you”).

Fan

a User who has opened a free fan account.

Partner

a business or other professional in the events industry, such as an artist management, a label, a promoter, a venue, a ticket seller or a media outlet, that uses the partner panel through an Organization.

Organization

a Partner’s account in the partner panel, with a team of people acting on the Partner’s behalf.

Team member

a Fan who created an Organization or accepted an invitation to it and acts on the Partner’s behalf in an assigned role: owner, manager, editor or viewer.

Consumer

a natural person who uses the Service for purposes not directly related to their business or profession. The provisions on Consumers also apply to a sole trader for whom the contract is not of a professional nature (Article 38a of the Polish Consumer Rights Act).

Seller

a ticket agency, promoter or other business selling tickets, including a resale platform, that the “Buy tickets” buttons lead to.

Offer

information about tickets for an event from a particular Seller: ticket type, price, availability and a link to buy.

Content

all information and material in the Service, including event, artist, venue and city data, Offers, descriptions, photos and links. Content provided by a Partner is Partner Content.

Alert

a notification by e-mail or in the Service: price drop, presale, new date and new video.

Featured event

an event marked as featured by the Editors on their own initiative or at a Partner’s request approved by the Editors (section 12).

Editors

the Provider’s staff and contractors who review and moderate Content and handle reports.

3.Provider and contact

1. 1.

   The Service is provided and operated by the company named below. Its full registration details are in the legal notice.

2. 2.

   The e-mail address below is the single point of contact for Users (Article 12 DSA) and for the authorities of the Member States, the European Commission and the European Board for Digital Services (Article 11 DSA). You can also send questions, complaints and reports to it. Letters can be sent to the Provider’s registered office.

3. 3.

   We accept and answer messages in the languages listed below. Every message is read and handled by a person; we do not use automated replies instead of contact with a human.

4.Services

1. 1.

   The Provider provides the services described below by electronic means. All of them are free.

2. 2.

   A contract for using the Service without an account is concluded when you open any of its pages and ends when you stop using the Service.

3. 3.

   A contract for a fan account is concluded for an indefinite period when you register and accept these terms. Alerts and the calendar are part of this contract and end at the latest when it ends.

4. 4.

   A contract for an Organization is concluded for an indefinite period when the Organization is created in the partner panel, where its founder accepts these terms on the Partner’s behalf. The services for Partners are described in section 10, section 11 and section 12.

5. 5.

   The Provider may develop the Service, add features and change how pages look. Changes that restrict the services described in these terms are made as changes to these terms (section 19).

5.Technical requirements and security

1. 1.

   To use the Service you need:

   1. 1)a device with internet access and an up-to-date web browser (for example Chrome, Firefox, Safari or Edge) with JavaScript and cookies enabled;
   2. 2)for a fan account and Alerts: a working e-mail address;
   3. 3)for the calendar: an app that can subscribe to calendars in iCalendar format (.ics);
   4. 4)for imports and the API: software that fetches and sends data over HTTPS in the formats described in the panel (CSV, iCalendar, schema.org, JSON).
2. 2.

   Without the necessary cookies you cannot sign in or send a form. Which cookies we use and why is explained in the cookie policy.

3. 3.

   Using the internet comes with general risks such as malware, phishing (pages and messages pretending to be well-known services in order to obtain your data), interception of unencrypted connections, or someone taking over your account after learning your password. The Service connects to your browser over an encrypted connection (HTTPS).

4. 4.

   Keep your software up to date, use a password you do not use anywhere else, do not share your password, calendar link or API tokens, and check the address of the page before you sign in.

5. 5.

   The Provider never asks for your password or card details by e-mail. You do not pay for tickets in the Service: payments take place only on Sellers’ websites.

6.Fan account

1. 1.

   You can open a fan account if you are a natural person aged 16 or over. When you sign up, you confirm that you meet this condition.

2. 2.

   To sign up you need a first name or nickname, an e-mail address, a password that meets the requirements shown in the form, and to confirm your age and accept these terms. We record the date of acceptance and the version of the terms. How we process personal data is explained in the privacy policy. Consent to the newsletter is optional, and you can withdraw it at any time in your account settings. A newsletter may only be sent to Fans who have given this consent.

3. 3.

   After you sign up we send you a link to confirm your e-mail address. Without confirming it you can use your account, but not Alerts.

4. 4.

   Your account is personal. Keep your password confidential and do not let others use your account. In settings you can see the devices you are signed in on and sign out the others. If you think someone knows your password, change it straight away.

5. 5.

   You set price-drop alerts and presale reminders on an event page, and following an artist turns on Alerts about the artist’s new dates. If you saved an event, you also get a presale reminder unless you turn it off in settings. Price and presale Alerts arrive straight away or in a daily digest, depending on your settings, and new dates arrive in the digest. Every Alert e-mail has an unsubscribe link that works with one click. An Alert is based on Offers that may change before you read it, so it does not guarantee a price or ticket availability.

6. 6.

   Your calendar link contains a private key. Anyone who knows it can see the events you marked “Going” and your first name or nickname. You can turn the link off or create a new one at any time. Changing your password and signing out other devices invalidate the link.

7. 7.

   In settings you can download a copy of your data in JSON format. The download link is valid for 7 days.

8. 8.

   You can terminate the contract at any time, without giving a reason, by deleting your account in settings (your password is required). From that moment you are signed out on all devices and Alerts and the calendar stop working. After 14 days, during the next nightly data clean-up, we delete your saves, follows, Alerts, notifications and other account data and anonymise the account itself. The contract then ends. Signing in before that time cancels the deletion.

9. 9.

   You can also terminate the contract by writing to the Provider at the address in section 3. We then delete the account in the same way. Deleting your account also ends your membership of Organizations’ teams.

7.Rules of use

1. 1.

   Use the Service lawfully, in line with these terms and good practice, and with respect for the rights of others.

2. 2.

   In particular, you must not:

   1. 1)provide unlawful content, including content that infringes copyright, trade mark rights, personal rights or image rights, or content inciting hatred or violence;
   2. 2)provide false or misleading data, in particular about events, dates, prices and ticket availability;
   3. 3)impersonate other people, artists, promoters, venues or Sellers, or claim profiles without authority;
   4. 4)use someone else’s account or API token, or share tokens with unauthorised people;
   5. 5)automatically extract Content (scraping, crawling) or copy the Service’s database in bulk, including by systematically extracting insubstantial parts of it, without the Provider’s written consent. This does not apply to indexing by search engines in line with robots.txt or to the access the Provider gives Partners in the panel and the API;
   6. 6)abuse the API, including exceeding limits or getting round them with several tokens, IP addresses, accounts or Organizations, or get round security measures, verification or moderation;
   7. 7)interfere with the Service, in particular by overloading it, introducing malware, exploiting bugs or testing its security without the Provider’s consent;
   8. 8)artificially generate clicks on “Buy tickets” buttons, page views, saves or follows, for example with bots or repeated clicking, to influence statistics, rankings or commission payments;
   9. 9)use the Service to send spam or unsolicited commercial communications.
3. 3.

   The Service’s database – the collection of events, artists, venues, cities and Offers and the links between them – is protected as a database in whose creation, verification and presentation the Provider has made a substantial investment (Polish Act of 27 July 2001 on the protection of databases, Directive 96/9/EC). Extracting or re-using all or a substantial part of it, or repeatedly and systematically extracting insubstantial parts of it, requires the Provider’s consent. Elements from open data sources can be obtained directly from their publishers (section 18).

4. 4.

   If you break these rules, the Provider may take the measures described in section 13.

8.You buy tickets from the sellers

1. 1.

   The Provider does not sell tickets, does not take payments and is not a party to the contracts Users conclude with Sellers or event promoters. The “Buy tickets” button takes you to the Seller’s website through a redirect address in the Service, or straight there for Offers with a direct link (section 9).

2. 2.

   Signed-in Fans see the Offers and buying links of all Sellers, the price comparison, the price history and price alerts. A User who is not signed in sees, on event pages and in event lists, the Offers and prices of the Service’s official partners (Sellers chosen by the Editors, currently the Sellers related to the Provider) and, in place of the others, the number of Sellers and an invitation to sign in or create a free account. The “from” price shown to such a User is calculated from the official partners’ Offers, and when another Seller offers a lower price, the Service says that more prices are available after signing in. The “Cheapest” badge always points to the cheapest of all the Offers shown.

3. 3.

   You conclude the contract to buy a ticket with the Seller, and the contract concerning attendance at the event with the promoter, on their terms: their terms and conditions, refund rules, fees and privacy policies. Refunds, exchanges, ticket complaints and changes or cancellations of events are handled by the Seller or the promoter.

4. 4.

   Information about events, prices, fees, availability and dates comes from Sellers, promoters, Partners and open data sources. We update it regularly, but it may change or turn out to be inaccurate. The information on the Seller’s website at the time of purchase is binding. Next to the offers table we say whether prices include service fees and when the data was refreshed.

5. 5.

   Offers from primary-market Sellers are marked “Official sale”, and offers from resale platforms “Resale” with a “Secondary market” badge. The Editors decide the type of each Seller based on information about its business. On the secondary market tickets are sold by other buyers: prices may exceed the face value, and the promoter may restrict reselling or transferring tickets.

6. 6.

   Some links to Sellers are affiliate links. If you buy a ticket after following a link from the Service, the Seller or an affiliate network may pay the Provider a commission. The commission is paid by the Seller: the Provider does not add it to the ticket price, and neither its amount nor whether a link is an affiliate link affects the order of Offers (section 9).

7. 7.

   Sellers’ websites and other websites linked from the Service are not part of the Service. Their owners’ rules apply there.

Official sale

Primary-market sale: a ticket agency, promoter or venue. These offers always come before resale.

Secondary market

Secondary-market resale. The price is shown as “from” because it depends on the ticket you choose.

Cheapest

The cheapest available official offer with a price. The main buy button on the event page leads to it, unless the event has an available Offer with a direct link (section 9).

9.How offers and events are ordered

1. 1.

   This section describes the main parameters that determine the order of Offers, events and search results, and their relative importance (Article 5 of the P2B Regulation, Article 27 DSA and the unfair commercial practices rules implementing Article 7(4a) of Directive 2005/29/EC).

2. 2.

   The order is set automatically by the Service’s software, by the same rules for all Sellers and Partners, with one exception: Offers with a direct link, currently the Offers of Sellers related to the Provider (section 8), come first in the offers table and at the main buy button. A higher position for an Offer or event cannot be bought. The amount of a commission and whether a link is an affiliate link do not affect the order.

3. 3.

   On event listings you choose the sort order yourself and narrow the results with filters: dates, city, type of event, price and genre. Other lists have the fixed order described below.

10.Partner account

1. 1.

   The partner account is meant for Partners, that is businesses and other professionals in the events industry. A Partner does not benefit from the protection given to Consumers, subject to section 16.

2. 2.

   An Organization can be created by a Fan with a confirmed e-mail address who is authorised to act on the Partner’s behalf. By creating it, they declare that they may represent the Partner and that the details given are true, and accept these terms on the Partner’s behalf. We record the date of these statements, the version of the terms and the person who made them. That person becomes the Organization’s owner. One person can own at most 3 unverified Organizations at a time.

3. 3.

   What the panel offers depends on the type of Organization: artist managements and labels manage artist profiles, promoters and venues manage events and venue profiles, ticket sellers manage their Seller profile, Partner Feed and the API. Every Organization has team settings, and the statistics available also depend on its type. The type of an Organization cannot be changed later by the Partner.

4. 4.

   Team members are invited by e-mail, and an invitation is valid for 7 days. The panel describes what each role (owner, manager, editor, viewer) may do. An Organization always has at least one owner, and owners sign in with two-factor authentication. The Partner is responsible for its Team members as for its own actions and makes sure only authorised people have access.

5. 5.

   The Editors verify an Organization by checking the Partner’s details (for example the VAT number, domain and contact details). Until it is verified, its events, profile changes and tour dates are published only after the Editors approve them. In a verified Organization, Team members with the right to publish do so without prior moderation, except for events that look like a duplicate of an existing listing: these go to the Editors. After verification, the name, country and VAT number can no longer be changed by the Partner. We send the Editors’ decisions on submitted events, profile changes and tour dates by e-mail to the Organization’s owners and to the person who submitted them; a refusal includes the reasons and how to appeal (section 14). A withdrawal of verification is explained in the same way.

6. 6.

   An artist management or label can claim an artist profile, and a promoter or venue a venue profile, by providing evidence. The Editors decide whether to hand over a profile, send the decision by e-mail and give reasons for a refusal. The Editors may hand a profile over to another Organization that shows a better right to it; the previous Organization is then sent a statement of reasons by e-mail (section 13).

7. 7.

   The Partner undertakes to:

   1. 1)provide true, current and complete information about events, dates, prices, fees, availability and cancellations, and correct it without delay;
   2. 2)publish only lawful events that it organises, at which artists it represents perform, which take place at its venue or for which it sells tickets;
   3. 3)provide only texts, photos, logos and other material it has the rights to, have the consent of people shown in photos, and credit the photographer where required;
   4. 4)not mislead about prices, fees or the type of sale (primary market or resale), and link tickets only to the Seller’s domain or an approved affiliate network;
   5. 5)comply with consumer protection law, including price information rules, and with the rules on selling and reselling tickets in the country of the event.
8. 8.

   The Partner grants the Provider a non-exclusive, royalty-free licence, without territorial limits, to use Partner Content as needed to run the Service: to record and reproduce it, adapt its format (for example scale and crop photos), and make it publicly available in the Service in all language versions, in structured data for search engines, in images for sharing on social media, in Alert e-mails and in calendars. The licence applies for as long as the services are provided and, after they end, to the extent the Content concerns events already published, backups and legal obligations. Intellectual property rights remain with the Partner or its licensors.

9. 9.

   Fields of an artist or venue profile changed by the Partner are locked so that automatic imports from open data sources (Wikidata, MusicBrainz, Wikimedia Commons) and other providers do not overwrite them; imports also do not overwrite changes to events made by Team members or the Editors. Fields the Partner has not changed may still be filled in and updated from these sources.

10. 10.

    In the panel the Partner can see aggregate statistics for its events, profiles and Offers, such as page views, unique visitors, Offer clicks, saves, follows and Alerts, depending on the type of Organization. Values below 5 are shown as “<5”. The Partner does not receive Fans’ personal data. Statistics can be exported to a CSV file. We keep daily aggregates for 760 days and the click log, which contains no personal data, for 30 days. When the contract ends, access to statistics in the panel ends too (Article 9 of the P2B Regulation).

11. 11.

    The Provider does not restrict Partners from offering the same events and tickets on different terms outside the Service. It does not sell tickets or offer its own events in the Service, so it treats no offer of its own differently from Partners’ Offers (Article 7 of the P2B Regulation). Any relationships with Sellers are disclosed in section 8.

11.Imports, Partner Feed and API

1. 1.

   Promoters and venues can import events from a CSV file (with a preview before saving), from an iCal calendar and from schema.org data on pages of a domain the Organization has verified with a meta tag or a DNS record. We fetch calendars and pages every 6 hours, and the Service’s crawler respects robots.txt on the Partner’s website.

2. 2.

   Once the Editors approve its Seller profile, a ticket seller can send events and Offers in Partner Feed v1 format: in a file at an address we fetch (pull) or through the REST API with a token (push). Ticket links must lead to the Seller’s domain, and the affiliate tracking template to the Seller’s domain or a known affiliate network. Other addresses are set by the Editors.

3. 3.

   API tokens are created and revoked by the Organization’s owners and managers. A token is shown only once, and the Provider stores only a hash of it. Keep tokens secret, do not put them in publicly accessible code, and revoke any token that may have leaked straight away. The Partner is responsible for actions taken with its tokens.

4. 4.

   The limits below apply. When the request limit is exceeded, the API answers with code 429 and a Retry-After header, and the Partner should retry after the time given. The Provider may raise limits at any time and lower them with at least 15 days’ notice, unless the security of the Service requires otherwise.

5. 5.

   Imports follow the same publication rules as other Partner Content (section 10). Events that disappear from the source are withdrawn from the Service, but when more than half of the events disappear from one fetch at once, nothing is withdrawn. The Partner can see import results and errors in the panel.

6. 6.

   Formats and the API may evolve. Backwards-incompatible changes to version v1 are announced at least 15 days in advance. Documentation is available in the partner panel.

12.Featured events

1. 1.

   An Organization can ask for one of its upcoming events that is not cancelled to be featured (“Feature event” in the panel), giving the placement (home page or city page) and the period: at most 31 days and no later than the day of the event.

2. 2.

   The Editors review the request. They may accept it, accept it for different dates or refuse it with reasons. We send the decision by e-mail. A request gives no right to be featured. The Editors may also feature an event on their own initiative.

3. 3.

   A featured event takes priority in the “Worth seeing” poster case and the “This weekend” section of a city page and is one of the criteria for choosing the event in the “Compare prices” module on the home page (section 9). With the home page placement the event also gets the biggest poster in the “Coming up” poster case on the home page, shown to visitors who picked the event’s city. Featuring does not change the order of ticket Offers, event listings or search results.

4. 4.

   An event featured at a Partner’s request carries the label “Featured by organizer” in these places, with an explanation that the featuring is free and comes from the event’s organizer. We do not present such events as an editorial pick.

5. 5.

   An Organization can withdraw a request that is awaiting a decision and a featured period that is still running. Featuring does not run while the Organization is suspended and ends when it is deleted (section 13).

6. 6.

   Featuring is currently free. Paid featuring or other paid services may only be introduced under separate terms that the Partner accepts before placing a paid order. Every paid featured event will be clearly labelled as promoted in the Service, and we will add a description of its effect on the order to section 9.

13.Restriction, suspension and termination

1. 1.

   The Provider may restrict or suspend the use of services, in particular stop publication, hide or remove Content, withdraw an Organization’s verification, turn off an import, a Seller profile or an API token, or terminate the contract, if a User:

   1. 1)breaks the law or these terms, in particular section 7, and in the case of a Partner also its obligations under section 10 and section 11;
   2. 2)provides illegal content or false data;
   3. 3)frequently submits manifestly unfounded notices or complaints (Article 23 DSA);
   4. 4)acts in a way that endangers the security of the Service, Users or third parties;
   5. 5)is subject to a legal obligation or an order of a competent authority that requires it.
2. 2.

   Measures are proportionate to the seriousness, impact and frequency of the breach. A suspension for frequently providing manifestly illegal content is for a reasonable period and follows a prior warning (Article 23 DSA).

3. 3.

   A suspension of an Organization lasts until the date given in the decision or until it is lifted. During it the partner panel is read-only: Content cannot be added, edited or published, events cannot be imported and featuring cannot be requested; the API answers with code 403 and the reasons, and the Partner’s files, calendars and pages are not fetched. Published Content stays in the Service unless the Editors restrict access to it. When a Seller profile is turned off, its Offers are not shown in the Service and the “Buy tickets” buttons lead to the event page.

4. 4.

   We send a decision to restrict, suspend or remove Content or an account to the person concerned, with a statement of reasons (section 14), at the latest when it takes effect, unless we do not have their contact details or the law forbids it.

5. 5.

   For a Partner, we send the statement of reasons for a restriction or suspension by e-mail before or at the latest when it takes effect. Terminating the whole contract with a Partner requires notice with reasons at least 30 days in advance. We send the notice by e-mail to the Organization’s owners, and the partner panel shows the day on which the Organization will be deleted. Until then the services continue unchanged unless the Editors suspend them by a separate decision. The Provider may terminate without notice where a legal obligation or an order of an authority requires it, where it exercises a right of termination for an imperative reason under national law, or where the Partner has repeatedly breached these terms (Article 4 of the P2B Regulation). The Partner can clarify the facts in a complaint (section 15). If a measure turns out to be unjustified, we reverse it without delay.

6. 6.

   A Fan can delete their account at any time (section 6). An owner can delete an Organization in its settings at any time. Published events then remain in the Service as event information (licence under section 10), and the Editors can restore the Organization at the Partner’s request within 30 days of its deletion. After that the Organization’s data is deleted for good. The same applies to an Organization deleted by the Editors, including after a notice period. The Partner can ask for its Content to be removed.

7. 7.

   The Provider may terminate the contract with a Fan for good reason, in particular when it stops providing the services, with 30 days’ notice sent by e-mail.

8. 8.

   When a contract with a Partner ends, Team members lose access to the Organization’s panel, statistics and API. The Provider keeps data only as long as the law requires or as needed to establish and pursue claims, as described in the privacy policy.

14.Illegal content and moderation

1. 1.

   Anyone can report to the Provider information in the Service that they consider illegal, for example content infringing copyright, fake events or fraudulent ticket Offers, by e-mail to the point of contact.

2. 2.

   A notice should contain (Article 16 DSA):

   1. 1)an explanation of why the person considers the information illegal;
   2. 2)the exact web address (URL) of the page with the information and, if needed, which part of it;
   3. 3)the name and e-mail address of the person reporting, except for notices of offences concerning child sexual abuse;
   4. 4)a statement that the person reporting believes in good faith that the information in the notice is accurate and complete.
3. 3.

   We confirm receipt of a notice, handle it in a timely, diligent, non-arbitrary and objective manner, and tell the person reporting about our decision and how to challenge it. Notices are handled by members of the Editors. We do not use automated tools for this.

4. 4.

   The Editors check the Content of unverified Organizations before publication. The Content of verified Organizations is published straight away and checked after a notice or a sign of a problem. We automatically check only the technical correctness of data from imports and the API (format, required fields, the domain of ticket links) and detect possible duplicates, which go to the Editors. We do not use automated tools to assess whether content is lawful or to remove content. Decisions about Content are made by a person.

5. 5.

   When we remove Content or disable access to it, restrict its visibility, suspend or end a service or close an account, we give the person concerned a statement of reasons containing (Article 17 DSA):

   1. 1)the type of measure, its scope and duration;
   2. 2)the facts and circumstances the decision is based on, including whether it was taken on the basis of a notice or on our own initiative;
   3. 3)information on any use of automated means;
   4. 4)the legal ground, if the content was found illegal, or the provision of these terms, if it was found incompatible with them;
   5. 5)information on the available means of redress.
6. 6.

   You can appeal a decision about Content or an account, including decisions about an Organization, within 6 months by replying to the e-mail with the decision or writing to the point of contact. We handle appeals free of charge, in a timely, non-discriminatory and diligent manner, under human supervision, and reverse the decision if the appeal is justified. You can also turn to a certified out-of-court dispute settlement body (Article 21 DSA) or to the courts.

7. 7.

   If we become aware of information giving rise to a suspicion of a criminal offence threatening the life or safety of persons, we inform the competent authorities without delay (Article 18 DSA). We comply with orders from authorities concerning illegal content and requests for information, and inform the people concerned as required by law.

15.Complaints

1. 1.

   You can make a complaint about the Service’s services, for example about your account, Alerts, the calendar, the partner panel, imports or the API, by e-mail to the point of contact or by letter to the Provider’s registered office (section 3).

2. 2.

   A complaint should include your contact details (and, if it concerns an account, the account’s e-mail address), a description of the problem, when it occurred and how you would like it resolved. A complaint is not rejected if this information is missing; we will ask for it if needed.

3. 3.

   We answer complaints by e-mail or letter within 14 days of receiving them. If a Consumer does not receive an answer within this time, the complaint is deemed accepted (Article 7a of the Polish Consumer Rights Act).

4. 4.

   Complaints about tickets, prices, refunds, and how events are run, changed or cancelled should be sent to the Seller or the promoter (section 8). We correct wrong information in the Service whenever it is reported.

5. 5.

   Partners can make complaints free of charge through the internal complaint-handling system (Article 11 of the P2B Regulation), in the same way as other complaints. A complaint may concern the Provider’s failure to comply with legal obligations, technical problems with the services, or measures the Provider has taken against the Partner, such as restricting or suspending services, refusing publication, or decisions about profiles, featured events and verification. We consider complaints with due care within 14 days and send the Partner an individual answer by e-mail. We publish information on how the complaint-handling system works where Article 11(4) of the P2B Regulation requires it.

16.Consumer rights and disputes

1. 1.

   The services are free. Consumers have the rights under the rules on contracts for the supply of digital services (Polish Consumer Rights Act) to the extent these rules apply to services provided without payment of a price.

2. 2.

   A Consumer who concluded the contract for an account at a distance may withdraw from it within 14 days of concluding it, without giving a reason, to the extent provided by law. It is enough to send a statement, for example by e-mail to the point of contact, or to delete the account in settings. Withdrawal costs nothing. In any case a Fan can delete their account at any time (section 6).

3. 3.

   Consumers can use out-of-court ways of handling complaints and claims, for example help from a municipal or district consumer ombudsman (in Poland), consumer organisations, permanent consumer arbitration courts at the regional Trade Inspection offices or, in cross-border disputes within the European Union, the European Consumer Centre in their own country. The Polish Office of Competition and Consumer Protection (UOKiK) provides information about these bodies and procedures. The Provider’s participation in out-of-court proceedings is voluntary.

4. 4.

   Contracts concluded under these terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection given by the mandatory provisions of the law of the country of their habitual residence (Article 6(2) of the Rome I Regulation).

5. 5.

   Disputes with Consumers are decided by the courts that have jurisdiction under the general rules. A Consumer domiciled in an EU Member State may also sue the Provider in the courts of their place of domicile. Disputes with Partners and other businesses are decided by the court competent for the Provider’s registered office.

6. 6.

   For disputes with Partners not resolved through a complaint (section 15), the Provider is willing to engage in mediation with the mediators named below (Article 12 of the P2B Regulation). The Provider takes part in mediation in good faith and bears a reasonable proportion of its costs. Mediation is voluntary and does not exclude going to court.

17.Liability

1. 1.

   The Provider is liable for properly providing its services under the general rules. Nothing in these terms excludes or limits liability towards Consumers where the law does not allow it, or liability for damage caused intentionally.

2. 2.

   The Provider works to keep the Service running without interruption, but technical breaks for maintenance, updates or fixing faults are possible. We try to announce longer planned breaks and hold them at quiet times. There is no guaranteed service level for the API and imports.

3. 3.

   The Provider is not liable for:

   1. 1)contracts Users conclude with Sellers and promoters, their performance, or how events are run, changed or cancelled;
   2. 2)the content and operation of Sellers’ websites and other external websites;
   3. 3)changes in prices, availability and dates after the data in the Service was last updated;
   4. 4)the consequences of a User sharing their password, calendar link or API token with others.
4. 4.

   As a hosting service provider, the Provider is not liable for Content provided by Partners and other Users if it does not know it is illegal and, once it becomes aware of it, removes it or disables access to it without delay (Article 6 DSA). The Partner is responsible for the Content it provides.

5. 5.

   Towards Partners, the Provider’s liability is limited to actual loss and excludes loss of profit, except for damage caused intentionally or through gross negligence.

18.Intellectual property and open data

1. 1.

   The Service, its layout and design, software, the Editors’ texts and the database are protected by law and belong to the Provider or are used under licence.

2. 2.

   You may use Content for your own personal use to the extent the law allows, in particular view it and share links to pages of the Service.

3. 3.

   Elements from open data sources keep their licences. Data from MusicBrainz and Wikidata is available under CC0 1.0 (no rights reserved). Photos from Wikimedia Commons are shown with the author and licence given next to the photo on the artist page (for example CC BY or CC BY-SA), and their use is subject to those licences. Their thumbnails elsewhere on the site, for example in search results, link to that page. Maps are made from OpenStreetMap data, available under the ODbL.

4. 4.

   Videos are played from YouTube on YouTube’s terms. The rights to them, and to the names, trade marks and logos of artists, Sellers and promoters, belong to their owners. We use them only to identify events and Offers.

5. 5.

   The rights to Partner Content remain with the Partner or its licensors. The scope of the Provider’s licence is described in section 10.

19.Changes to these terms and final provisions

1. 1.

   The Provider may change these terms for good reason, such as a change in the law or an order of an authority, a change in the scope or way the services are provided, new features, a change in technology, or the need to ensure security and prevent abuse.

2. 2.

   We announce changes on this page and, to Fans and Partners, also by e-mail at least 15 days before they take effect. For Partners this is the minimum period under Article 3(2) of the P2B Regulation, and we extend it when a Partner needs to make technical or commercial adjustments. Changes do not apply retroactively.

3. 3.

   A shorter period or a change with immediate effect is possible only where a legal obligation or an order of an authority requires it, or where the change is needed to address an unforeseen and imminent danger to the Service, Users or third parties (Article 3(4) of the P2B Regulation).

4. 4.

   A Fan or Partner who does not accept the changes may terminate the contract with immediate effect before they take effect, by deleting the account or Organization or by writing to the Provider. A Partner can waive the notice period by submitting new Content during it or by a clear statement.

5. 5.

   This version of the terms is in force from 13 November 2026. Version of 29 October 2026.

6. 6.

   Matters not covered by these terms are governed by Polish law, in particular the Civil Code, the Act on providing services by electronic means and the Consumer Rights Act, as well as the P2B Regulation and the DSA. If any provision turns out to be invalid, the others remain in force.
